US DOT 49 CFR Hazmat, OSHA HazCom 2012, EPA TSCA & ITAR/EAR Export Compliance
Statutory Jurisdiction: US DOT PHMSA (49 CFR Parts 100–185), OSHA 29 CFR 1910.1200, US BIS EAR / DDTC ITAR
Executive Summary: Mandatory US regulatory compliance notice covering Class 3 Flammable Resins (UN1866), Class 5.2 Organic Peroxide Catalysts (MEKP UN3105), OSHA GHS Safety Data Sheets, and ITAR/EAR Carbon Fiber export controls.
1. US Department of Transportation (DOT) 49 CFR Hazardous Materials Regulations Many composite matrix systems indexed on CompositeMatrix are regulated hazardous materials under **49 CFR Parts 100–185** (Pipeline and Hazardous Materials Safety Administration — **PHMSA**): - **UN1866 — Resin Solution, Flammable (DOT Hazard Class 3, Packing Group II / III)**: Includes styrene-monomer Vinyl Ester Resins (e.g., *CoREZYN® CORVE8100*, *Derakane™ 411-350*, *AOC Vipel®*) and unsaturated Polyester Resins. - **UN3105 — Organic Peroxide Type D, Liquid (DOT Hazard Class 5.2)**: Includes Methyl Ethyl Ketone Peroxide (**MEKP**) initiators and Cumene Hydroperoxide catalysts. Requires segregated Hazmat LTL freight and certified hazardous materials carriers. - **UN3082 — Environmentally Hazardous Substance, Liquid, N.O.S. (Class 9)**: Certain Bisphenol-A / Bisphenol-F infusion epoxy systems.
**Commercial Receiving Requirement**: Buyers ordering 55-gallon drums, totes, or MEKP catalyst packages warrant that their shipping destination is a **commercial industrial facility, shipyard, or fabrication shop** equipped to receive DOT Hazardous Materials LTL/FTL freight.
2. OSHA Hazard Communication Standard (29 CFR 1910.1200 — HazCom / GHS) In accordance with the US Occupational Safety and Health Administration (**OSHA**) Hazard Communication Standard (**29 CFR 1910.1200**), every chemical product fulfilled by a verified distributor on CompositeMatrix is accompanied by a manufacturer-issued **16-Section GHS Safety Data Sheet (SDS)**. Employers are solely responsible for maintaining workplace SDS binders, monomer ventilation (EPA MACT standards for boat manufacturing, 40 CFR Part 63 Subpart VVVV), and PPE compliance.
3. EPA TSCA Chemical Inventory & California Proposition 65 Notice - **EPA TSCA**: All polymer resins and curing agents listed for US commerce are certified by their respective manufacturers/importers as listed on (or exempt from) the **Toxic Substances Control Act (TSCA)** inventory. - **California Proposition 65 Warning (Cal. Health & Safety Code § 25249.6)**: ⚠️ **WARNING**: Certain composite resins and reinforcing products sold through distributor storefronts contain chemicals including **Styrene**, **Bisphenol-A (BPA)**, or airborne glass/carbon filaments known to the State of California to cause cancer, birth defects, or other reproductive harm.
4. US Export Controls — ITAR (22 CFR Parts 120–130) & EAR (15 CFR Parts 730–774) High-modulus aerospace and defense composite materials—including specific intermediate- and high-modulus **Carbon Fiber tows, prepregs, and aramid ballistics (ECCN 1C010 / 1C210)**—are subject to the **Export Administration Regulations (EAR)** administered by the US Department of Commerce Bureau of Industry and Security (**BIS**) and/or the **International Traffic in Arms Regulations (ITAR)** administered by the US Department of State (**DDTC**).
Buyers agree **not** to export, re-export, or transfer any controlled composite material outside the United States or to any restricted foreign national or entity listed on the US Treasury **OFAC Specially Designated Nationals (SDN)** list or BIS Entity List.
